Terms of Service

1. Agreement to Terms

By accessing or using Preach Kit ("the Service"), operated by Preach Kit ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These terms apply to all users, including pastors, church staff, and any other individuals or organizations using the Service.

2. Description of Service

Preach Kit is an AI-powered platform that helps churches repurpose sermon content into multiple formats, including blog posts, social media content, video clips, devotionals, and other outputs. The Service includes the web application, APIs, and all related tools.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to create an account.
  • One person or organization may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

4. Subscriptions and Payments

Billing

  • Paid plans are billed in advance on a monthly or annual basis via Stripe.
  • Prices are in US Dollars and do not include applicable taxes, which will be added where required.
  • You authorize us to charge your payment method for recurring subscription fees.

Refund Policy

All payments are final. We do not offer refunds for any subscription fees, partial-month usage, or unused features. If you experience a technical issue that prevents you from using the Service, please contact us at [email protected] and we will work to resolve it.

Cancellation

  • You may cancel your subscription at any time from your account settings.
  • Cancellation takes effect at the end of the current billing period. You will retain access until then.
  • We do not provide prorated refunds for the remaining days in a billing period.

Price Changes

We may change subscription prices with 30 days' notice. Price changes take effect at the start of your next billing cycle. Continued use after a price change constitutes acceptance of the new price.

5. Your Content

Ownership

You retain all rights to content you upload to the Service, including sermon recordings, notes, slides, and any other materials ("Your Content"). We do not claim ownership of Your Content.

License to us

By uploading content, you grant us a limited, non-exclusive, non-transferable license to process, store, and transform Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or close your account.

Generated outputs

Content generated by the Service from Your Content (blog posts, carousels, scripts, etc.) belongs to you. You are free to use, modify, publish, and distribute generated outputs without restriction.

Your responsibilities

  • You are solely responsible for the accuracy and appropriateness of Your Content and any generated outputs you publish.
  • AI-generated content may contain errors. You should review all outputs for theological accuracy before publishing.
  • You must have the right to upload any content you submit (e.g., you have permission to use music, images, or third-party materials in your recordings).

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Upload content that infringes on the intellectual property rights of others.
  • Upload content containing hate speech, harassment, or threats.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Use the Service to send spam or unsolicited communications.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Resell, sublicense, or redistribute the Service without our written consent.
  • Use automated tools (bots, scrapers) to access the Service beyond normal API usage.

7. Service Availability

  • We strive for high availability but do not guarantee uninterrupted access. The Service may be unavailable during maintenance, updates, or unforeseen outages.
  • We may modify, suspend, or discontinue features of the Service at any time with reasonable notice.
  • Processing times for content generation are estimates and may vary based on file size, server load, and complexity.

8. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by Preach Kit and protected by copyright and trademark laws. These Terms do not grant you any rights to our intellectual property except as needed to use the Service.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability to you for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for the accuracy, completeness, or appropriateness of AI-generated content. You are solely responsible for reviewing and publishing content.

10. Indemnification

You agree to indemnify and hold harmless Preach Kit, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your publication of generated content.

11. Termination

  • You may close your account at any time by contacting us.
  • We may suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful activity.
  • Upon termination, your right to use the Service ceases immediately. Your uploaded content will be deleted within 30 days of account closure.

12. Dispute Resolution

  • These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law provisions.
  • Any disputes arising from these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association, unless you opt out within 30 days of creating your account by emailing [email protected].
  • You agree to resolve disputes individually and waive any right to participate in class-action lawsuits or class-wide arbitration.

13. Changes to Terms

We may modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on the Service. Your continued use after changes take effect constitutes acceptance.
